Wills and Trusts
Wills and Trusts are estate planning documents which provide for the distribution of assets that are titled in your individual name at the time of your death. It is important to do a Will or Trust so that you, rather than the state of Florida, determine the disposition of your assets. If you have children who are minors it is critical to do a Will so that you can name a guardian for your child or children in the event of the death of both you and your spouse. It is also most important for your Will to establish a testamentary trust so that in the event of your death, your children’s assets can be properly managed. A Living Trust can be useful if you have a more complicated estate or complicated situation, however there are many unscrupulous businesses that are selling these items to members of the public when they are not necessary.
Durable Power of Attorney
A properly-drafted Durable Power of Attorney helps your family avoid having to go through the expense and emotional trauma that can result from having to establish a guardianship for a parent or loved one.
With a Living Will, you let your physicians and family members know if you want heroic measures or life prolonging procedures to be used in the event that you have a terminal condition with no realistic chance of recovery. A Living Will can alleviate you and your family members from the suffering caused by prolonging the dying process.
WARNING. IF YOU INTEND TO LEAVE ANY ASSETS TO RELATIVES OR FRIENDS IN CUBA—READ THIS FIRST.
